Peterson and Peterson represents clients involved in the Texas probate process. In the typical case, we assist the executor in getting Letters Testamentary and in carrying out the fiduciary duties required by law in dealing with creditors and distributing estate assets to beneficiaries. Types of Proceedings
Translation to EnglishWe can help determine whether a probate proceeding is needed and how to proceed, if applicable. When someone dies in Texas with a will in which an executor is named, the probate process is often fairly straight-forward. We help the executor file the will and the proper pleadings to have Letters Testamentary granted. We then work with the executor to prepare and file an Inventory, a Notice to Creditors, and various other documents through the closing of the estate. If someone dies without a will, a court determination of the proper heirs may be necessary to establish the proper link in the chain of title to real estate, among other important steps. |
